U.S. Transportation Secretary Sean P. Duffy Issues Revised NEVI Guidance to Accelerate EV Charger Deployment

In a significant policy shift, U.S. Transportation Secretary Sean P. Duffy has released revised guidance for the National Electric Vehicle Infrastructure (NEVI) Formula Program, aiming to cut bureaucratic delays and help states more effectively build electric vehicle charging stations.

Secretary Duffy criticized the previous administration’s approach, stating that unnecessary mandates and complex rules left 84% of program funds unspent. “If Congress is requiring the federal government to support charging stations, let’s cut the waste and do it right,” he said, emphasizing that while he does not favor subsidizing green energy, he is committed to respecting Congress’ intent and ensuring federal dollars are used efficiently.

The revised Interim Final Guidance, effective immediately, streamlines the application process and provides states with more flexibility in deploying charging infrastructure. States are required to submit their updated EV Infrastructure Deployment Plans within 30 days.

Notably, the updated guidance eliminates many of the previous requirements related to community engagement, environmental reviews, and grid integration. States will no longer be required to specifically target disadvantaged communities or address issues such as emergency evacuation needs, resilience planning, or small business participation. The new approach allows states more discretion in determining the distance between charging stations and in selecting locations where site hosts also own the charging infrastructure, a move intended to accelerate project delivery.

The changes align with Executive Order 14154, which prioritizes energy independence and reduces regulatory burdens. By stripping down plan content to statutory requirements and minimizing consultation burdens, the Department hopes to get EV chargers installed faster and restore public confidence in the program’s purpose and effectiveness.
